BUCKHANNON – An Upshur County man was arrested over the weekend for allegedly attempting to steal a folding camping cart from the Buckhannon Walmart.

Daniel L. Workman, 47, of Buckhannon, was arrested Saturday, April 1, for third-offense shoplifting, a felony, in connection to an incident that allegedly occurred in mid-March.

According to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by Sgt. Darin Hissam with the Buckhannon Police Department, on March 15, 2023, Workman entered Walmart in Buckhannon. He subsequently went to the Sporting Goods Department and selected an Ozark Trail all-terrain folding camping cart.

He then allegedly walked to one of the store’s main exits without paying for the merchandise and attempted to leave the store when Store Asset Protection detained him. The merchandise was valued at $81.08, Hissam noted in the report. According to the criminal complaint, Workman has two prior convictions of shoplifting following guilty pleas with dates of Aug. 8, 2016, in Upshur County and June 3, 2019, in Lewis County.

Upshur County Magistrate Alan Suder set bail at $10,000 cash or surety, and Workman remained incarcerated in the Tygart Valley Regional Jail as of Tuesday afternoon, according to the West Virginia Division of Corrections & Rehabilitation.

Shoplifting is graduated offense that is considered a felony on the third or subsequent charge. The potential penalty for a conviction of shoplifting third offense is a fine of not less than $500 nor more than $5,000 and confinement in the state penitentiary for one to 10 years.
