Upshur woman arrested for felony shoplifting after allegedly taking tray, breakfast snack cakes

BUCKHANNON – An Upshur County woman was arrested after allegedly stealing a tray and some snack cakes from the 88 Lounge.

Brittany Hurst, 33, of Buckhannon, was arrested for third-offense shoplifting, a felony.

According to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by Lt. Doug Loudin with the Buckhannon Police Department, on Thursday, Feb. 8, Hurst allegedly took a tray and breakfast snack cakes from The 88 Lounge located at 88 East Main Street and concealed the items in her handbag.

According to the report, she allegedly walked out of the establishment without paying for the items. Records show Hurst was convicted of second-offense shoplifting in Upshur County Magistrate Court on Aug. 14, 2018, at which time she entered a guilty plea for an offense that occurred on March 24, 2018, the file states.

The total value of the items allegedly stolen from The 88 Lounge was $125.

Bail was set at $5,000 cash or surety by Upshur County Magistrate Mark Davis.

The potential penalty for a conviction of third-offense shoplifting is a fine of not less than $500 nor more than $5,000, and confinement in a state penitentiary for not less than one year nor more than 10 years; at least one year shall actually be spent in confinement and is not subject to probation, according to State Code cited in the file.
