An Upshur County grand jury returned 25 indictments in the September 2026 term, according to a press release issued Monday by prosecuting attorney Bryan Hinkle’s office.
Jason Howard Wilmoth, 40, of Buckhannon, was indicted for failure to provide notice of a change to required sex offender registration information, life registrant, second offense, a felony.
Gary Matthew Gundersen, 43, of Buckhannon, was indicted for soliciting a minor via computer, a felony; use of obscene matter with intent to seduce a minor, a felony, two counts; failure to provide notice of change to required sex offender registration information, lifetime registrant, a felony; and sexual assault in the third degree, a felony.
Lee Auston Godbey, 29, of Summersville, was indicted for distribution and exhibition of material depicting minors engaged in sexually explicit conduct, a felony, two counts.
Phillip Roy Ogden, 39, of Rock Cave, was indicted for domestic battery, third or subsequent offense, a felony, two counts.
Curtis Lee Meahl, 35, of Buckhannon, was indicted for driving while in an impaired state, third or subsequent offense, a felony, two counts; child neglect creating substantial risk of death or serious bodily injury, a felony, two counts; and operating a motor vehicle not equipped with an approved motor vehicle test and lock system, a misdemeanor.
Gregory Vincent Baisi, 32, of Buckhannon, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony, and driving a motorcycle without a valid motorcycle license, a misdemeanor.
Thomas Griffin Cawley, 59, of Bristol, Virginia, was indicted for incest, a felony, 11 counts.
Theresa Ann Criss, 54, of Buckhannon, was indicted for malicious assault, a felony; domestic battery, second offense, a misdemeanor; domestic assault, second offense, a misdemeanor; and obstructing an officer, a misdemeanor.
Zacherie Keith Kitzmiller, 31, of Keyser, was indicted for uttering, a felony, and forgery, a felony.
Kayla Michelle Miller, 36, of Buckhannon, was indicted for financial exploitation of an elderly person, protected person or incapacitated adult, a felony, and fraudulent scheme, a felony.
Brandon Michael Beeson, 40, of Buckhannon, was indicted for burglary, a felony, and grand larceny, a felony.
Blaine Tabor Browning, 39, of Buckhannon, was indicted for strangulation, a felony; domestic battery, a misdemeanor; and unlawful restraint, a misdemeanor.
James Allen Ware, 43, of Buckhannon, was indicted for possession of a combined controlled narcotic substance with the intent to deliver, a felony, and driving while in an impaired state, a misdemeanor.
Landon William Farrar, 18, of Buckhannon, was indicted for attempted burglary, a felony; intimidation of a witness, a felony; domestic assault, a misdemeanor; assault, a misdemeanor; and violation of a protective order, a misdemeanor.
Jared Nolan Bryant, 23, of Buckhannon, was indicted for retaliation against a public official, a felony, four counts; battery on a law enforcement officer, a misdemeanor; assault on a law enforcement officer, a misdemeanor; and obstructing a law enforcement officer, a misdemeanor.
Alexander Eugene Stephens, 49, of Buckhannon, was indicted for wanton endangerment involving a firearm, a felony; prohibited person in possession of a firearm, a felony, three counts; and domestic assault, a misdemeanor.
Brandon Wayne Day, 36, of Elkins, was indicted for entry of a building other than a dwelling, a felony, and petit larceny, a misdemeanor.
Reuben Benjamin Krum, 49, of Buckhannon, was indicted for domestic battery, third or subsequent offense, a felony.
Christopher Austin Eberly, 28, of Buckhannon, was indicted for strangulation, a felony; domestic battery, a misdemeanor; and domestic assault, a misdemeanor.
Thomas Clayton Summers, 37, of Buckhannon, was indicted for burglary, a felony; harassment, a misdemeanor; petit larceny, a misdemeanor; and harassing telephone calls, a misdemeanor, 11 counts.
Jacob Michael Ham, 19, of Buckhannon, was indicted for fraudulent scheme, a felony; grand larceny, a felony; and embezzlement, a felony.
James William Champ, 48, of Fairmont, was indicted for grand larceny, a felony, and entry of a building other than a dwelling, a felony.
Ralph Allen Martin, 37, of Buckhannon, was indicted for fraudulent use of an access device, a felony.
Jennifer Lyn Moreland, 42, of Buckhannon, and Billy Jack McKinnon, 42, of Buckhannon, were indicted for delivery of a controlled narcotic substance within 1,000 feet of a school, a felony, three counts, and conspiracy to violate Chapter 60A, Article 4, Section 401 of the West Virginia Code, a felony, two counts.
Roger Glen Gooden, 45, of Tallmansville, was indicted for delivery of a controlled substance, methamphetamine, a felony, and fraudulent scheme, a misdemeanor.
The press report notes that an indictment is merely an accusation and all defendants are presumed innocent unless and until proven guilty.
