Local residents face charges related to death of two children as Upshur County Grand Jury returns 28 total indictments in May term

An Upshur County Grand Jury returned 28 indictments on Monday, according to a press release from the prosecuting attorney’s office.

Thomas Wesley Cunningham, 27, of Buckhannon, WV, was indicted for Death of a Child by a Guardian, Custodian, or Other Person by Child Abuse, a felony, two counts.

Ciera Nicole Gillespie, 26, of Buckhannon, WV, was indicted for Child Neglect Resulting in Death, a felony, two counts.

Eric Wade McClure, 31, of Buckhannon, WV, was indicted for Delivery of a Controlled Narcotic Substance, a felony, one count.

Brandon Michael Beeson, 36, of Buckhannon, WV, was indicted for Possession of a Controlled Substance with the Intent to Deliver, a felony, one count; Conspiracy to Commit a Felony Violation of Chapter 60A, Article 4, Section 401 of the W. Va. Code, a felony, one count.

Roy Lee Lahman, 30, of Rock Cave, WV, was indicted for Intimidation of a Public Employee, a felony, one count; Retaliation against a Public Employee, a felony, two counts.

Trey Amadeus Johnson, 24, of Buckhannon, WV, was indicted for Fleeing in a Vehicle with Reckless Indifference to the Safety of Others, a felony, one count; Fleeing in a Vehicle while Under the Influence of Controlled Substances, a felony, one count.

Christina Michele Haggerty, 30, of Weston, WV, was indicted for Burglary, a felony, one count; Conspiracy, a felony, one count.

Trey Amadeus Johnson, 24, of Buckhannon, WV, was indicted for Fraudulent Use of an Access Device, a felony, three counts.

Gary Allen Ramsey, 36, of Clarksburg, WV, was indicted for Grand Larceny, a felony, one count; Conspiracy, a felony, one count.

Joshua Ryan Wilson, 33, of Clarksburg, WV, was indicted for Grand Larceny, a felony, one count; Conspiracy, a felony, one count.

Kenneth Henry Knight, Jr., 38, of Buckhannon, WV, was indicted for Failure to Provide Notice of Changes to Child Abuse and Neglect Registration Information, 2nd or Subsequent Offense, a felony, two counts; Violation of a Protective Order, a misdemeanor, one count; Fleeing by means other than the use of a vehicle, a misdemeanor, one count; Petit Larceny, a misdemeanor, one count.

Gregg Scott Haymond, 50, of Buckhannon, WV, was indicted for Failure to Provide Notice of Sex Offender Registration Changes, Life Registrant, Second Offense, a felony, three counts.

James Daniel Givens, 26, of Martinsburg, WV, was indicted for Grand Larceny, a felony, one count; Fraudulent Scheme, a misdemeanor, two counts.

Kenneth Lee Bevans, 27, of Buckhannon, WV, was indicted for Possession of a Controlled Substance with the Intent to Deliver, a felony, one count; Conspiracy to Commit a Felony Violation of Chapter 60A, Article 4, Section 401 of the W.Va. Code, a felony, one count; Prohibited Person in Possession of a Firearm, a felony, two counts. Presented by Special Prosecuting Attorney Michael Parker.

Amanda Dawn Golden, 44, of Buckhannon, WV, was indicted for Failure to Provide Notice of Changes to Sex Offender Registration Information, Life Registrant, a Felony, three counts.

James David Heater, 41, of Buckhannon, WV, was indicted for Receiving or Transferring Stolen Vehicle, a felony, one count; No Registration, a misdemeanor, one count; No Insurance, a misdemeanor, one count.

Code, a felony, one count.

Emily Sierra Nolan, 28, of Buckhannon, WV, was indicted for Delivery of a Controlled Narcotic Substance within 1000 Feet of a School, a felony, one count; Conspiracy to Commit a Felony Violation of Chapter 60A, Article 4, Section 401 of the W.Va. Code, a felony, one count.

David Mark Payne, 65, of Buckhannon, WV, was indicted for Delivery of a Controlled Substance, a felony, two counts.

Bryan David Shaw, 41, of Buckhannon, WV, was indicted for Delivery of a Controlled Substance, a felony, two counts.

Kevin James Cline, 44, of Buckhannon, WV, was indicted for Delivery of a Controlled Substance within 1000 Feet of a School, a felony, one count; Delivery of a Controlled Substance, a felony, one count.

Allen Blake Wolford, 32, of Buckhannon, WV, was indicted for Delivery of a Controlled Narcotic Substance, a felony, two counts.

Upshur County Prosecutor Bryan Hinkle’s office notes that “an indictment is merely an accusation. All defendants are presumed innocent unless and until proven guilty.”
