Buckhannon man held on $100,000 bail after being arrested on multiple drug charges

BUCKHANNON – A Buckhannon man was arrested Saturday after several illegal substances were allegedly found in his residence.

Bryan Shaw, 41, of Buckhannon, was arrested for possession with intent to deliver methamphetamine, possession with intent to deliver heroin, possession with intent to deliver illegal mushrooms, and being a prohibited person in possession of a firearm.

According to the criminal complaint in the Upshur County Magistrate Clerk’s Office, on March 18, 2023, at approximately 6:45 a.m., multiple members of the Upshur County Sheriff’s Department executed a search warrant at a residence on Pine Lane in Buckhannon.

As officers entered the residence, Shaw came from his bedroom and met investigating officer deputy TR Collins in the kitchen. He complied with Collins’ orders and got face down on the floor, the complaint states. Shaw was handcuffed and read his Miranda Rights, and he allegedly admitted there would be illegal drugs in his room.

Collins searched Shaw’s room and found multiple illegal items, according to the file.

“During this search, the following items were located: portable scanner, black plastic lid with approximately three bags of crystal-like substance and two heroin stamps, plastic case with approximately four bags of crystal-like substance and a plastic bag that contained a brown dried substance consistent with illegal mushrooms and a glass vile with a dried brown substance, along with crystal-like substance, a glass vile with crystal-like substance inside of it, $639 in U.S. currency, $51.50 of change, a loaded flare gun, multiple used heroin stamps, multiple pieces of burnt foil, one half-smoked marijuana ‘joint,’ and other drug paraphernalia,” Collins wrote in the report.

Shaw had previously been convicted of a felony, the officer noted.

Bail was set at $100,000 cash only by Upshur County Magistrate Alan Suder.

The potential penalty for possession with intent to deliver methamphetamine is confinement in a state correctional facility for not less than one year nor more than 15 years, a fine of not more than $25,000, or both.

The potential penalty for possession with intent to deliver heroin is confinement in a state correctional facility for not less than one year nor more than 15 years, a fine of not more than $25,000, or both.

The potential penalty for possession with intent to deliver illegal mushrooms is confinement in a state correctional facility for not less than one year nor more than five years, a fine of not more than $15,000, or both.

The potential penalty for being a prohibited person in possession of a firearm is confinement in a state correctional facility for not more than five years, a fine of not more than $5,000, or both.
