Man arrested for felony domestic battery after victim says he broke her jaw

BUCKHANNON – An Upshur County man was arrested Saturday for felony domestic battery after the female victim told police he broke her jaw during an altercation in the Cambridge Heights Apartment complex.

Terry Pumphrey, 44, of Buckhannon, was arrested for domestic battery third offense, a felony, and possession of a controlled substance, a misdemeanor.

According to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by investigating officer Sgt. Thomas Posey with the Buckhannon Police Department on Saturday, Jan. 23, Posey and officer Angel McCauley, also with the BPD, responded to a domestic incident in Cambridge Heights Apartments.

The file says that when Posey and McCauley arrived, they could hear a woman screaming inside the apartment. Posey and McCauley entered the apartment and once inside, they found the victim and Pumphrey in a bedroom. According to the report, the victim was pleading for help, stating, “He broke my jaw.”

The victim reportedly had a small cut above her eye and redness and swelling on the left side of her face. The victim allegedly told officers that Pumphrey “beat the hell out of [her].”

The file says Pumphrey has two prior convictions for domestic battery in Upshur County on May 28, 2019 and April 1, 2008. According to the report, a search also revealed a meth pipe and a small bag of meth concealed on Pumphrey’s person.

Bail was set at $30,000.

The potential penalty for a conviction of domestic battery third offense is confinement for not less than one year, nor more than five years, and the court may impose a fine of not less than $3,000 nor more than $5,000. The possible penalty for a conviction of possession of methamphetamine is confinement for a term of 90 days to six months, a fine of up to $1,000 or both.
