BUCKHANNON – A Buckhannon man has been arrested for allegedly trespassing in the Valley Green apartment complex.
Alan Lee Stanley, 39, was arrested Tuesday, March 5, when Deputy Tyler A. Gordon with the Upshur County Sheriff’s Department responded to 608 Valley Green Dr. for three separate calls regarding Stanley allegedly breaking into that apartment, according to the complaint filed in the Upshur County Magistrate Clerk’s Office.
Stanley has been banned from the Valley Green Apartment complex since Aug. 20, 2018, according to the file.
However, on Dec. 9, 2018 Gordon, Deputy Tyler Chidester and Cpl. Josh Wilson with the Buckhannon Police Department responded to the residence to arrest Stanley on an outstanding warrant for destruction of property.
According to the report, on that day, Stanley was arrested and was advised in front of all the officers that he was banned from the Valley Green Complex. Since the December 2018 incident, Stanley has been advised at least three times by law enforcement to stay off the premises, the report says.
However, there have reportedly been approximately 14 calls in regard Stanley being present at 608 Valley Green Dr.
This past Tuesday, March 5, Gordon arrested Stanley at the same address after receiving phone calls from several people.
He was charged with trespassing, a misdemeanor, and violating bond, also a misdemeanor.
On Dec. 10, 2018, Stanley had been released on bond with the condition that he have no direct or indirect contact with a certain individual. However, Stanley voluntarily showed Gordon, the investigating officer, text messages between himself and that individual, claiming the person had invited him over, according to the report.
Magistrate Kay Hurst set Stanley’s bond at $10,000 for violation of bond and $10,000 for trespassing.
If Stanley is convicted, he faces being confined in jail not less than one day nor more than one year, and the jail term is required to include actual confinement of not less than 24 hours; he would also be fined between $250 to $2,000 for violation of bond.
If convicted on the trespassing charge, he also faces being fined not less than $100 nor more than $500 or being confined for a period not to exceed 12 months or both fined and confined for trespassing.
In other non-related crime news, on Saturday, March 2, Andrew Wagner, 27, of Volga, was charged with burglary, a felony, after he allegedly entered the hallway leading to apartment 41 W. Main St., according to the complaint filed in the magistrate clerk’s office.
When Anita Wells, a contract worker, entered the building to finish the apartment, she noticed Wagner in the hallway. Wells asked Wagner to leave several times, and he allegedly refused, the complaint states. He then allegedly followed Wells and her aunt, Debra Dillow, into the apartment.
When the three entered the apartment, Dillow reportedly attempted to block Wagner’s path and told him he did not belong there.
According to the file, Wagner then used physical force to push past the worker’s aunt to gain further access to the apartment. When Wagner forced his way past Dillow, he allegedly caused her to fall on her back on the apartment steps and then proceeded to pull the handrailing from the wall, damaging the wall.
Wagner remained in the residence until investigating officer Patrolman Donald S. Kraemer with the Buckhannon Police Department made him leave.
Wagner’s bail has been set at $20,000 by Magistrate Kay Hurst.
If convicted, Wagner faces being confined in the state correctional facility not less than one nor more than 15 years for burglary.
