Buckhannon man arrested after traffic stop reveals revoked license

BUCKHANNON – A Buckhannon man was arrested this week after an officer discovered he was driving with a revoked license.

Michael Wagoner, 34, of Buckhannon, was arrested for driving revoked for DUI, third offense.

According to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by investigating officer Trooper C.C. Jones with the Buckhannon detachment of the West Virginia State Police, on Jan. 24, 2024, Cpl. Turansky and Jones were conducting a routine patrol on Camden Avenue in Buckhannon when Jones observed a silver Hyundai Santa Fe driving northbound with a defective headlight and a defective exhaust.

Jones initiated his emergency lights and conducted a traffic stop on the vehicle, according to the complaint. The driver, later identified as Wagoner, allegedly said he did not have a driver’s license, and Jones conducted an inquiry through the Department of Motor Vehicles.

“[The officer] discovered Mr. Wagoner was operating a motor vehicle while his operator’s license was revoked by the State of West Virginia for DUl with a conviction date of Oct. 2, 2017,” the complaint states. “Mr. Wagoner was further convicted of driving while license revoked for DUI with conviction dates of Nov. 7, 2018, and Oct. 29, 2020. This incident would make Mr. Wagoner’s third offense.”

Bail was set at $10,000 cash or surety by Upshur County Magistrate Mark Davis.

The potential penalty for driving revoked for DUI third offense is confinement in a state correctional facility for not less than one year nor more than three years, and, in addition to the mandatory prison sentence, a fine of not less than $3,000 nor more than $5,000.
