Buckhannon man arrested for escape from custody

BUCKHANNON – An Upshur County man who left his residence without permission while serving a home confinement sentence on a separate charge was located and arrested Saturday.

Daniel T. Dunlavy, 32, of Buckhannon, was arrested Sept 10 for escape from custody, a felony.

According to the criminal complaint filed in the Upshur County Magistrate Clerk’s Office by Sgt. R.S. Rolenson with the Upshur County Sheriff’s Office, Dunlavy was serving a home confinement sentence on a separate charge when he allegedly “unlawfully and intentionally” left his approved residence on June 26, 2022. Rolenson, who filed the complaint June 30, 2022, noted that Dunlavy also allegedly allowed his GPS-monitoring bracelet to expire.

The complaint says Dunlavy had been serving a court-ordered home confinement sentence for one to three years for a conviction of driving revoked for DUI third or subsequent offense.

“Numerous attempts have been made to locate the defendant without success,” Rolenson wrote June 30.

The West Virginia Regional Jail & Correctional Facility Authority website shows Dunlavy was arrested Sept. 10 and is currently lodged in the Central Regional Jail on a $10,000 cash-only bail. The penalty for a conviction of escape from custody is imprisonment in the state penitentiary for a term of up to five years.
