Upshur County Grand Jury returns 40 indictments, including eight for gross child neglect creating a serious risk of death or serious bodily injury

BUCKHANNON — An Upshur County Grand Jury returned 40 indictments on Tuesday, according to a press release from the prosecuting attorney’s office.

Greg Robert Tenney, 23, of Rock Cave – Possession of a Controlled Substance with the Intent to Deliver, a felony, one count; Conspiracy to Violate Chapter 60A, Article 4, Section 401 of the W.Va. Code, a felony, one count.

Beverly Ann Helmick, 46, of Volga – Delivery of a Controlled Substance, a felony, one count.

Dakota Shane Kahlbaugh, 21, French Creek – Fraudulent Use of an Access Device, a felony, four counts; Tampering with an Automobile, a misdemeanor, one count; Petit Larceny, a misdemeanor, one count; Conspiracy, a misdemeanor, one count.

Robert William Smith, 43, of Buckhannon – Domestic Battery, Third Offense, a felony, one count; Violation of a Protective Order, a misdemeanor, one count.

Timothy Edward Wilson, 43, of French Creek – Fleeing in a Vehicle with Reckless Indifference to the Safety of Others, a felony, one count; No Insurance, a misdemeanor, one count; No Registration, a misdemeanor, one count.

John Edwin White, 49, of Clarksburg – Grand Larceny, a felony, one count; Conspiracy, a felony, one count.

Alice Lenora Linger, 50, of Tallmansville – Gross Child Neglect Creating Substantial Risk of Death or Serious Bodily Injury, a felony, one count; Animal Cruelty, a misdemeanor, seven counts; Creating, Contributing to, or Operating an Open Dump, a misdemeanor, one count.

Brandon Matthew King, 42, of Buckhannon – Retaliation Against a Public Employee, a felony, two counts; Brandishing a Firearm or Other Deadly Weapon, a misdemeanor, one count; Obstructing an Officer, a misdemeanor, one count.

Clayton Dale Kimble, 36, of Tallmansville – Distribution and Exhibiting of Material Depicting a Minor Engaged in Sexually Explicit Conduct, a felony, one count.

Upshur County Prosecutor Bryan Hinkle’s office notes that “an indictment is merely an accusation. All defendants are presumed innocent unless and until proven guilty.”
