Upshur Commission accepting county prosecuting attorney applications through Nov. 6

BUCKHANNON – The Upshur County Commission gave an update on replacing retiring Upshur County Prosecuting Attorney David Godwin.

Godwin’s last day will be Nov. 30, he informed commissioners in an Oct. 22 letter.

County commissioner Terry Cutright said he spoke with assistant prosecuting attorney Kelley Cunningham, and she was not interested in the position.

“Kelley advised me at this time she was not interested in the position. She really likes her assistant prosecutor’s job,” Cutright said. “With that being said, I think we should make a motion that we notify the local bar members and have them turn in their resumes if they are interested in the job by 4:30 p.m. Nov. 6 at our office.”

Commissioner Kristie Tenney seconded the motion.

Cutright said they will review resumes Nov. 7, will set interviews for Nov. 14 and will likely make an appointment by Nov. 21. County administrator Carrie Wallace said the appointment will take effect Dec. 1 at 12:01 a.m. and the appointed individual must be the same party as Godwin, who is a registered Republican.

The appointment will last until Godwin’s term would have been up on Dec. 31, 2020.
