Man admits to unlawfully possessing firearm in Upshur County

ELKINS, W.Va. – Dustin Cain Anderson, of Clarksburg, W.Va., has admitted to a firearms charge, Acting United States Attorney Randolph J. Bernard announced Friday.

Anderson, 27, pleaded guilty to one count of “Unlawful Possession of a Firearm.” Anderson, a person prohibited from having firearms, admitted to having a .22 caliber revolver in November 2020 in Upshur County.

Anderson is facing up to 10 years of incarceration and a fine of up to $250,000. Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.

Assistant U.S. Attorney Christopher L. Bauer is prosecuting the case on behalf of the government. The Bureau of Alcohol, Tobacco, Firearms and Explosives and the Upshur County Sheriff’s Office investigated.

U.S. Magistrate Judge Michael John Aloi presided.
