BUCKHANNON – A Lewis County man was arrested after allegedly taking his brother’s credit card without permission in August.

Jonathon Lane, 26, of Crawford W.Va. was arrested Wednesday for fraudulent use of an access device, a felony.

According to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by investigating officer Deputy Cole Bender with the Upshur County Sheriff’s Office, on Aug. 26, Bender received a direct call to the sheriff’s office concerning fraudulent use of an access device.

The caller informed Bender that his brother, Lane, allegedly took his Mastercard from his residence in Crawford, which is located in Lewis County. The caller informed Bender that Lane waited a week and then allegedly used his card several times without consent.

According to the report, while the card was in Lane’s possession, he allegedly used it at the Arlington Mini-Mart in Rock Cave to make a purchase of $8.30. The caller was able to provide Bender with pictures of Lane using the card at the mini-mart, along with a receipt of the transaction.

Bail was set at $20,000.

The potential penalty for conviction of fraudulent use of an access device is confinement in the state penitentiary for up to 10 years, a fine of up to $10,000 or both.
