Attempted murder, arson, DUI causing death among charges in recent Upshur County indictments

A circuit court indicted area residents on a range of charges, including arson, DUI causing death, child neglect, embezzlement, drug offenses, assault, burglary, and possession of firearms, involving more than two dozen individuals.

An Upshur County Grand Jury returned 28 indictments on Monday, according to a press release from Prosecuting Attorney Bryan Hinkle’s office. The indictments are as follows:

Emily Page Spracklen-Hamner, 37, of Buckhannon, was indicted for malicious wounding, a felony; assault, a misdemeanor (two counts); and brandishing a deadly weapon, a misdemeanor.

Joshua Barton Foster, 34, of West Milford, was indicted for DUI causing death, a felony, and aggravated DUI, a misdemeanor.

Landon James Kincaid, 20, of Buckhannon, was indicted for intimidation or harassment of a witness, a felony.

Joseph Ryan Lane, 35, of Crawford, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony, and no insurance, a misdemeanor.

Colten Darrell Lester, 36, of Buckhannon, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony.

Brittany Hope Hurst, 34, of Buckhannon, was indicted for arson in the second degree, a felony (four counts); arson in the third degree, a felony; and destruction of property, a felony (three counts).

Dustyn Linn Walton, 29, of Tallmansville, was indicted for attempted murder, a felony, and malicious assault, a felony.

Justin David Rogers, 43, of Buckhannon, was indicted for obtaining money by false pretenses, a felony.

Jeremy Wade Ables, 40, of Weston, was indicted for shoplifting, third offense, a felony.

Woodie Thomas Cole II, 45, of Audra, was indicted for strangulation, a felony; burglary, a felony; child abuse resulting in injury, a felony; and domestic battery, second offense, a misdemeanor.

Kristy Dawn Heckler, 28, of Hambleton, was indicted for battery on a law-enforcement officer, second offense, a felony; obstructing an officer, a misdemeanor; and disorderly conduct, a misdemeanor.

Trayka Faye Hinchman, 23, of Buckhannon, was indicted for delivery of a controlled substance, methamphetamine, a felony (two counts).

Kashia Marie Williams, 34, of Buckhannon, was indicted for conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, a felony, and delivery of a controlled substance, methamphetamine, a felony.

Jeffrey Scott Chapman, 40, of French Creek, was indicted for gross child neglect creating substantial risk of death or serious bodily injury, a felony, and domestic battery, a misdemeanor.

Tellie Gene Gibson, 52, of Buckhannon, and Christopher Robert Taylor, 50, of Tallmansville, were indicted for burglary, a felony, and conspiracy, a felony.

Jeffrey Scott Chapman, 40, of French Creek, was separately indicted for entry of a building other than a dwelling, a felony, and grand larceny, a felony.

Jeremiah Michael Burkhammer, 19, of French Creek, was indicted for suffocation, a felony, and gross child neglect creating substantial risk of death or serious bodily injury, a felony (three counts).

Debbie Lynn Perrine, 36, of Rock Cave, was indicted for gross child neglect creating substantial risk of death or serious bodily injury, a felony; possession of a controlled substance, methamphetamine, a misdemeanor; driving under the influence of controlled substances, a misdemeanor; and possession of a controlled substance, marijuana, a misdemeanor.

Liam Benjamin Roby, 19, of French Creek, was indicted for distribution and display to a minor of obscene matter, a felony (three counts), and intimidation of a public employee, a felony (two counts).

Benjamin James Dickerson, 38, of Buckhannon, was indicted for receiving or transferring stolen goods, a felony (two counts), and conspiracy, a felony (two counts).

Samantha Kelly Dickerson, 33, of Buckhannon, was indicted for grand larceny, a felony, and conspiracy, a felony.

Ronald Lee Winneberger, 55, of Buckhannon, was indicted for possession of a controlled substance with intent to deliver, methamphetamine, a felony; possession of a controlled substance with intent to deliver, marijuana, a felony; conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, a felony; and prohibited person in possession of a firearm, a misdemeanor.

James Benton Simons, 54, of Buckhannon, was indicted for prohibited person in possession of a concealed firearm, a felony; wanton endangerment involving a firearm, a felony; prohibited person in possession of a firearm, a misdemeanor (three counts); and possession of a controlled substance, methamphetamine, a misdemeanor.

Patrick Bryan Stafford, 42, of Buckhannon, was indicted for domestic battery, third or subsequent offense, a felony (two counts), and intimidation of a witness, a felony.

Mikela Marie Mitchell, 40, of French Creek, was indicted for embezzlement, a felony (two counts).

Mikela Marie Mitchell, 40, of French Creek, was separately indicted for grand larceny, a felony (ten counts), and petit larceny, a felony (two counts).

Jonathon John Herron, 39, of Buckhannon, was indicted for failure to provide notice of a change to required sex-offender registration information, life registrant, second offense, a felony (three counts).

Jamie Lynn Lee, 43, of Buckhannon, was indicted for burglary, a felony, and petit larceny, a misdemeanor.

The press release notes that an indictment is merely an accusation and all defendants are presumed innocent unless and until proven guilty.
