BUCKHANNON – An Upshur County woman was arrested after allegedly possessing firearms while living with a man prohibited from owning firearms.
Destiny Riley, 25, of French Creek, was arrested for conspiracy to commit a felony, a felony.
According to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by Upshur County Sheriff’s Deputy Cpl. T.R. Collins, on Oct. 18, 2023, during the arrest of Riley and a second individual, Riley allegedly stated another woman had given her multiple firearms for protection.
Riley was adamant the woman had merely loaned her the firearms.
However, during two interviews with the woman Riley referenced, the woman stated she did not loan anyone any firearms, let alone Riley or the man with whom Riley was living.
The man prohibited from possessing firearms told police that Riley knew he was unable to possess firearms, and the firearms were accessible to both he and Riley, as they were not locked up and were stored in their shared bedroom.
Upshur County Magistrate Mark Davis set bail at $30,000 cash or surety.
The potential penalty for a conviction of conspiracy to commit a felony is confinement in the penitentiary for not less than one nor more than five years, a fine of up to $10,000, or, in the discretion of the court, both.
