BUCKHANNON – An Upshur County man was arrested last week after officers pulled him over while he was allegedly in possession of approximately 18 grams of methamphetamine and 62 pills identified as Tramadol.
Charles S. Cutright, 23, of French Creek, was arrested for possession with intent to deliver tramadol and for possession with intent to deliver methamphetamine, both felonies.
According to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by investigating officer Sgt. Marshall O’Connor with the Buckhannon Police Department, on Tuesday, Nov. 16 while on patrol, BPD officer Sgt. Tom Posey saw Cutright driving a gray 2005 Dodge Ram east on Island Avenue.
The file says Posey had previous knowledge that Cutright’s driver’s license was suspended in West Virginia and initiated a traffic stop on Virginia Avenue. While conducting the traffic stop, BPD officer Sgt. William Courtney and K-9 Officer Erros performed a free-air sniff around the outside of the vehicle.
According to the report, the canine showed a positive indication for the presence of the odor of a controlled substance. A search of the vehicle was then conducted, resulting in the seizure of approximately 18.24 grams of methamphetamine allegedly split up between five individual zip-top bags and 62 pills identified as Tramadol. Tramadol is a synthetic opioid that is classified as a Schedule IV controlled substance.
Officers also allegedly discovered and seized individual bags for repackaging, a digital scale and a Taurus G3c 9-mm handgun with a loaded magazine and one round already in the chamber. Police subsequently searched Cutright and allegedly found $598 in cash and another loaded magazine for the firearm.
Bail was set at $50,000 cash or surety by Upshur County Magistrate Alan Suder.
The penalty for a conviction of possession with intent to deliver Tramadol is confinement in a state prison for not less than one year nor more than three years, a fine of up to $10,000 or both.
The penalty for possession with intent to deliver methamphetamine is confinement in a state correctional facility for not less than one year nor more than 15 years, a fine of up to $25,000 or both.
