BUCKHANNON – A Lewis County was arrested after being pulled over without a license.

Shana Frazier, 34, of Lost Creek, W.Va., was arrested for driving revoked DUI third offense, a felony.

According to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by investigating officer deputy Cole Bender with the Upshur County Sheriff’s Office, on the night of Dec. 11, 2022, Bender was on patrol when he observed a white hummer opposite of him on Brushy Fork Road.

At the light, Bender observed the Hummer’s blinker, indicating it was going to turn left, while Bender’s intention was to go straight. When the traffic control light turned from red to green, Bender began to drive through the intersection; however, he had to slam on his brakes when the Hummer cut in front of him and continued west. Bender then followed the Hummer on Route 33 west before initiating a traffic stop on the vehicle at the Huddle House.

According to the report, Bender contacted the driver, Frazier, who said she did not have a driver’s license, and neither did her passenger. When asked if there was anything illegal in the vehicle, Frazier said there was marijuana in her bag. Upon search of the vehicle, assisted by fellow deputies with the sheriff’s office and Buckhannon city police officers, various drug paraphernalia was found along with the marijuana.

After checking Frazier’s license status through the West Virginia DMV via the Upshur County E911 Communication Center, Bender was advised that her license had been revoked for DUI.

Frazier has had two prior convictions for driving while license revoked for DUI, with conviction dates of July 14, 2020, and Jan. 29, 2021.

Bail was set at $15,000 cash or surety by Upshur County Magistrate Alan Suder.

The penalty for a conviction of driving revoked DUI third offense is confinement in a state correctional facility for not less than one year nor more than three years and a fine of not less than $3,000 nor more $5,000.
