Upshur County grand jury returns 41 indictments

An Upshur County grand jury returned 41 indictments Tuesday, alleging offenses from drug and sex crimes to attempted murder and a DWI-related death.

An Upshur County grand jury returned 41 indictments on Tuesday, according to a press release from Prosecuting Attorney Bryan Hinkle’s office.

  1. Matthew Eli Whitehead, 28, of Belington, West Virginia, was indicted for driving while in an impaired state and proximately causing the death of another person, a felony, one count; driving while in an impaired state and causing serious bodily injury to another person, a felony, one count; and driving while in an impaired state, a misdemeanor, one count.
  2. Randall Gene Bender Jr., 44, of Buckhannon, West Virginia, was indicted for failure to provide notice of a change to required sex offender registration information, life registrant, second offense, a felony, two counts; and failure to report to verify required sex offender registration information, life registrant, second offense, a felony, one count.
  3. Anastasia Evelyn Kendall, 22, of Buckhannon, West Virginia, was indicted for falsifying accounts, a felony, six counts.
  4. Jared Nolan Bryant, 21, of Buckhannon, West Virginia, was indicted for computer fraud, a felony, two counts; and unlawful use of an access device, a felony, two counts.
  5. Charles Dale Clemens, 75, of French Creek, West Virginia, was indicted for sexual abuse of a child by parent, guardian, custodian, or person in a position of trust, a felony, two counts; and sexual abuse in the first degree, a felony, two counts.
  6. James Olen Murphy Jr., 64, of Bridgeport, West Virginia, was indicted for fleeing in a vehicle with reckless indifference to the safety of others, a felony, one count; attempt to flee by means other than the use of a vehicle, a misdemeanor, one count; and obstructing an officer, a misdemeanor, one count.
  7. Joshua Small II, 42, of Buckhannon, West Virginia, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony, one count.
  8. Brandi Dawn Martin, 39, of Buckhannon, West Virginia, was indicted for gross child neglect creating substantial risk of death or serious bodily injury, a felony, one count.
  9. Michael Craig Courtney, 41, of Buckhannon, West Virginia, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony, one count.
  10. Alan Lee Stanley, 45, of Buckhannon, West Virginia, was indicted for possession of a controlled narcotic substance with the intent to deliver, fentanyl/xylazine, a felony, one count; and delivery of a controlled narcotic substance, fentanyl/xylazine, a felony, one count.
  11. Alan Lee Stanley, 45, of Buckhannon, West Virginia, was indicted for malicious assault, a felony, two counts; and suffocation, a felony, one count; sexual servitude of an adult, a felony, 29 counts.
  12. Christian Lee Lyons, 48, of Charleston, West Virginia, was indicted for uttering, a felony, one count.
  13. James Anderson Roy, 59, of Rock Cave, West Virginia, was indicted for failure to provide notice of a change to required sex offender registration information, life registrant, second or subsequent offense, a felony, three counts.
  14. Gione De Jesus Azevedo, 37, of Newark, New Jersey; Joao Batista Da Fonseca, 45, of Newark, New Jersey; and Bruno Martins Ferreira, 34, of Newark, New Jersey, were indicted for robbery in the first degree, a felony, one count; and conspiracy to commit a felony crime of violence against a person, a felony, one count.
  15. James Robert Arbogast, 53, of French Creek, West Virginia, was indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony, one count.
  16. David Michael Leggett, 42, of Orlando, West Virginia, was indicted for possession of a controlled narcotic substance with the intent to deliver, fentanyl, a felony, one count; possession of a controlled narcotic substance with the intent to deliver, fentanyl/xylazine, a felony, one count; possession of a controlled substance with the intent to deliver, methamphetamine, a felony, one count; possession of a controlled substance, marijuana, a misdemeanor, one count; possession of a controlled substance, alprazolam, a misdemeanor, one count; possession of a controlled substance, clonazepam, a misdemeanor, one count; prohibited person in possession of a concealed firearm, a felony, one count; and prohibited person in possession of a firearm, a misdemeanor, two counts; reckless driving, a misdemeanor, one count.
  17. Tiffany Dawn Sparks, 44, of Buckhannon, West Virginia, was indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony, one count.
  18. Andrew Devon Hitt, 25, of Buckhannon, West Virginia, was indicted for threats of terroristic acts, a felony, two counts.
  19. Jocelyn Marie Krum, 28, of Cross Lanes, West Virginia, was indicted for attempted murder, a felony, one count; wanton endangerment, a felony, one count; burglary, a felony, two counts; use or presentation of a firearm during the commission of a felony, a felony, one count; and prohibited person in possession of a firearm, a felony, one count.
  20. Randall William Osburn, 65, of Buckhannon, West Virginia, was indicted for failure to provide notice of a change to required sex offender registration information, life registrant, second offense, a felony, six counts.
  21. James Anderson Roy, 59, of Rock Cave, West Virginia, was indicted for prohibited person in possession of a firearm, a felony, two counts.

William Arthur Large, 56, of Buckhannon, West Virginia, was indicted for prohibited person in possession of a concealed firearm, a felony, one count; prohibited person in possession of a firearm, a misdemeanor, one count; and possession of a controlled substance, methamphetamine, a misdemeanor, one count.

Briton Eugene Herron, 18, of Buckhannon, West Virginia, was indicted for possession of counterfeit bank notes with intent to utter, a felony, one count; prohibited person in possession of a concealed firearm, a felony, one count; prohibited person in possession of a firearm, a misdemeanor, one count; and driving while in an impaired state, a misdemeanor, one count; reckless driving, a misdemeanor, one count; no insurance, a misdemeanor, one count.

Joshua Dale Cutright, 36, of Horner, West Virginia, and Katelynn Marie Wine, 26, of Buckhannon, West Virginia, were indicted for delivery of a controlled substance within 1,000 feet of a school, fentanyl, a felony, one count; and conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, a felony, one count.

Kelly Dawn Harvey, 41, of Buckhannon, West Virginia, and Willie Junior DeBarr Jr., 36, of Buckhannon, West Virginia, were indicted for delivery of a controlled substance within 1,000 feet of a school, fentanyl, a felony, one count; conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, a felony, one count; and delivery of a controlled substance, fentanyl, a felony, one count.
  29. Sara Jo Loudin, 34, of Buckhannon, West Virginia, was indicted for delivery of a controlled narcotic substance, buprenorphine, a felony, three counts.
  30. Kevin Donald Casto, 46, of Buckhannon, West Virginia, was indicted for delivery of a controlled narcotic substance, fentanyl, a felony, three counts.
  31. Kiley Ann Parson, 46, of Buckhannon, West Virginia, was indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony, one count.
  32. Damond Ersel Phillips, 44, of Montrose, West Virginia, was indicted for fleeing in a vehicle with reckless indifference to the safety of others, a felony, one count; forgery of a title or registration, a felony, one count; and driving while license revoked for DUI, a misdemeanor, one count; no insurance, a misdemeanor, one count.
  33. Joe Allen Ball, 61, of Buckhannon, West Virginia, was indicted for wanton endangerment involving a firearm, a felony, six counts; obstructing an officer, a misdemeanor, one count; shooting within 500 feet of a dwelling, a misdemeanor, six counts.
  34. David Christopher Perrine, 36, of Rock Cave, West Virginia, was indicted for domestic violence, third or subsequent offense, a felony, one count; and brandishing a deadly weapon, a misdemeanor, one count.
  35. Rayne Prince Marion Chuma, 22, of Powder Springs, Georgia, was indicted for attempted malicious assault, a felony, two counts; and wanton endangerment involving explosive material, a felony, two counts.

  38. Warren Harry McCarthy, 19, of Buckhannon, West Virginia, was indicted for sexual assault in the first degree, a felony, two counts; and sexual abuse in the first degree, a felony, one count.
  39. Franklin Lee Tefft, 49, of Buckhannon, West Virginia, and Lindsay Jo Chapman, 43, of Buckhannon, West Virginia, were indicted for possession of a controlled substance with the intent to deliver, methamphetamine, a felony, one count; conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, a felony, one count; and prohibited person in possession of a firearm, a misdemeanor, one count.
  40. James Carroll Tenney, 43, of Buckhannon, West Virginia, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony, one count.
  41. Ervin William Hinkle, 41, of Rock Cave, West Virginia, was indicted for possession of a controlled substance with the intent to deliver, methamphetamine, a felony, one count; conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, a felony, one count; and possession of a controlled substance, marijuana, a misdemeanor, one count.

The press release notes that an indictment is merely an accusation and all defendants are presumed innocent unless and until proven guilty.
