Man arrested following Aug. 15 Hickory Flat Road wreck

BUCKHANNON – A French Creek man was arrested last Thursday following a collision that occurred on Hickory Flat Road.

Investigating officer Cpl. Dewaine Linger with the Upshur County Sheriff’s Department said Wednesday he arrested 22-year-old Kody Gibbons for third-offense driving with a suspended license and no insurance.

According to the accident report filed by Linger, the wreck happened Thursday, Aug. 15 at 5:11 p.m.

The report says Gibbons was driving a green 1995 Jeep Cherokee, traveling on Hickory Flat Road towards Mt. Carmel. Meanwhile, Travis Mccutchan, 30, of Buckhannon, was driving a green 2002 Nissan Xterra when he was on Hickory Flat Road heading in the opposite direction.

The vehicles met in a turn that was not very sharp, according to the file. Gibbons could have moved another five feet, but failed to do so, Linger wrote in the report. McCutchan was over as far as he could be, the officer noted.

Gibbons was also allegedly traveling at a high rate of speed, Linger concluded his speed caused the accident.

The report said a passenger with Mccutchan, Larissa Unger, 29, suffered a possible injury but was not transported by Upshur EMS.

The report also said Gibbons was driving with a suspended license; with a vehicle registration violation; and no insurance.

“I arrested him for driving with a suspended license, third offense, and no insurance,” Linger told My Buckhannon Wednesday. “He has since bonded out.”
