Buckhannon man found with drugs during arrest on a separate warrant

BUCKHANNON – The Upshur County Sheriff’s Office arrested a man last week who was allegedly involved in a wreck in early February.

Tony L. Metzler, 36, was arrested for second-offense driving revoked for DUI, a misdemeanor, and possession with intent to deliver, a felony.

The original charge stems from an incident that allegedly occurred on Feb. 2, 2021, according to the criminal complaint in the Upshur County Magistrate Clerk’s Office filed by investigating officer Sgt. Rodney Rolenson with the Upshur County Sheriff’s Office.

Rolenson investigated a head-on collision on the Gould Road on Feb. 2, after which Metzler was allegedly seen running from the vehicle. Metzler’s sister remained on scene. She said was the driver and admitted her brother ran from the vehicle. The other driver involved in the accident, however, said the male was driving and ran from the scene, the police report says.

According to the file, Metzler was driving a 2004 black Durango. A driver’s license check through the E911 Upshur County Communication Center confirmed that Metzler had his driver’s license revoked because of a DUI, with an effective date of revocation May 8, 2014 and a first offense effective date of July 24, 2016.

According to the report, Metzler’s sister later admitted to her probation officer that her brother was driving the car.

A second criminal complaint filed in the magistrate clerk’s office filed by Upshur County Sheriff’s Deputy Seth Cutright indicated that on Wednesday, March 10, Metzler was found to be in possession of a controlled substance. He was allegedly in possession of a crystal-like substance, believed to be methamphetamine, in a bag, U.S. currency and scales.

A press release from the Upshur County Sheriff’s Office said Metzler was found with 66 grams of methamphetamine.

Bail was set at $26,000.

The penalty for a conviction of second-offense driving revoked for DUI is confinement in jail for a period of not less than six months nor more than one year and a fine of not less than $1,000 nor more than $3,000. The penalty for a conviction of possession with intent to deliver is confinement in a state correctional facility for not less than one year nor more than 15 years or a fine of not more than $25,000 or both fined and confined.
