Elkins man arrested for allegedly stealing used tires

BUCKHANNON – An Elkins man who allegedly stole used tires from a local business was charged with three misdemeanors when police arrested him Sunday.

Harold Vandevander, 25, was charged with petit larceny, conspiracy, and driving while suspended non-DUI, third offense – all misdemeanors – following an incident that allegedly occurred Sunday, Jan. 13 at Corridor H Tire on the Old West Road.

According to the complaint filed in the Upshur County Magistrate Clerk’s office by investigating officer Cpl. Theron Caynor, Vandevander and three other individuals reportedly traveled to Corridor H Tire from the Elkins area to take the tires.

“The defendant and three others went [behind] the building and took approximately 10 used tires from the business and loaded them into a truck and left,” Caynor wrote in the report.

Vandevander and the other three people – who Caynor did not identify in the report – were subsequently stopped by officers with the Buckhannon Police Department on the Hall Road in a green Ford F-150 truck, the complaint states.

When officers checked Vandevander’s license through the E911 Upshur Communication Center, the Comm Center reported Vandevander’s license had been suspended, according to the report. Information provided by the Comm Center also indicated Vandevander had three prior driving while suspended non-DUI offenses with the dates of June 23, 2015; July 15, 2015 and Feb. 14, 2018.

Caynor said the owner of Corridor H Tire arrived at the scene of the traffic stop on Hall Road and said he hadn’t given Vandevander permission to take the tires, which were worth approximately $400.

“The defendants came from Elkins to take the tires,” Caynor wrote in the report.

Magistrate Kay Hurst set bond at $6,000 cash/surety, and as of Monday evening, Vandevander was no longer listed on the West Virginia Regional Jail Authority website.

The penalty for a conviction of petit larceny is confinement in jail for up to one year and/or a fine of up to $2,500, while the punishment for a conviction of misdemeanor conspiracy is imprisonment for up to a year and/or a fine of up to $1,000.

The penalty for being found guilty of driving while suspended non-DUI, third offense, is imprisonment for 30 to 90 days and a fine ranging from $150 to $500.
