Upshur County Grand Jury returns 25 indictments, including solicitation of murder

BUCKHANNON, W.Va. — An Upshur County Grand Jury returned 25 indictments on Monday, according to a press release from the prosecuting attorney’s office.

Jaymie Wright, age and address not listed, was indicted for Attempt to Kill or Injure by Poison, a felony, three (3) counts; and Solicitation of Murder, a felony, one (1) count. This indictment was presented by Special Prosecuting Attorney Savannah Hull Wilkins.

Dylan Paul Mitchell, 22, of Buckhannon, was indicted for Gross Child Neglect Creating a Substantial Risk of Death or Seriously Bodily Injury, a felony, one (1) count.

Harley David King, 43, of Buckhannon, was indicted for Driving While License Revoked for DUI, 3rd or Subsequent Offense, a felony, one (1) count; No Insurance, a misdemeanor, one (1) count; and Improper Use of Evidence of Registration, a misdemeanor, one (1) count.

Danolvis Nunez, 20, of Suffolk, N.Y., was indicted for Grand Larceny, a felony, one (1) count; and Conspiracy, a felony, one (1) count.

Kiara Dawn Casto, 22, of Buckhannon, was indicted for Conspiracy to Commit a Felony Violation of Chapter 61A, Article 401 of the WV State Code, a felony, one (1) count; Gross Child Neglect Creating a Substantial Risk of Death or Serious Bodily Injury, a felony, one (1) count; and Conspiracy, a felony, one (1) count.

Ernie Wayne Crawford, 26, of French Creek, was indicted for Delivery of a Controlled Narcotic Substance, Fentanyl, a felony, one (1) count; Conspiracy to Commit a Felony Violation of Chapter 61A, Article 401 of the WV State Code, a felony, one (1) count; Gross Child Neglect Creating a Substantial Risk of Death or Serious Bodily Injury, a felony, one (1) count; and Conspiracy, a felony, one (1) count.

Jeremy Allan McCartney, 28, of Crawford, was indicted for Driving While License Revoked for DUI, 3rd or Subsequent Offense, a felony, one (1) count.

Christopher Allen Linville, 28, of Huntington, was indicted for Grand Larceny, a felony, one (1) count; Possession of a Stolen Vehicle, a felony, one (1) count; Attempted Identity Theft, a felony, one (1) count; Fleeing in a Vehicle with Reckless Indifference to the Safety of Others, a felony, one (1) count; Fleeing by Means Other than the Use of a Vehicle, a misdemeanor, one (1) count; and Destruction of Property, a misdemeanor, one (1) count.

Tony Lee Metzler, 37, of Buckhannon, was indicted for Prohibited Person in Possession of a Concealed Firearm, a felony, one (1) count; Prohibited Person in Possession of a Firearm, a misdemeanor, one (1) count; and Driving While License Revoked for DUI, 2nd Offense Charge, a misdemeanor, one (1) count.

William Earl Parker, Jr., 53, of Cheat Lake, W.Va., was indicted for Kidnapping, a felony, one (1) count.

Eric Wade Chidester, 39, of Crawford, was indicted for Prohibited Person in Possession of a Firearm, a felony, one (1) count; and Possession of a Stolen Vehicle, a felony, one (1) count.

Johnathan Roy Peyatt, 36, of French Creek, was indicted for Failure to Register as a Sex Offender, a felony, one (1) count.

Silmer Nathan White, 28, of Montrose, was indicted for Uttering, a felony, two (2) counts.

Kaylee M. Malcolm, 24, of Montrose, was indicted for Uttering, a felony, one (1) count.

Kurtis L. Carson, 20, of Weston, was indicted for Cruelty to Animals, a felony, two (2) counts.

William Patrick O’Neil, 51, of Spencer, was indicted for Uttering, a felony, one (1) count.

Charles William Pancake, 73, of Buckhannon, was indicted for Failure to Provide Notice of a Change in Sex Offender Registration Information, Life Registrant, a felony, two (2) counts.

Aaron Shane Glasser, 37, of Buckhannon, was indicted for Failure to Report Changes to Child Abuse and Neglect Registry, 2nd or Subsequent Offense, a felony, ten (10) counts.

Thomas James Miller, 32, of French Creek, was indicted for Driving While License Revoked for DUI, 3rd or Subsequent Offense, a felony, one (1) count; and Fleeing in a Vehicle with Reckless Indifference to the Safety of Others, a felony, one (1) count.

Christie Coy McClure, Jr., 58, of Buckhannon, was indicted for Driving a Motor Vehicle While in an Impaired State and Causing the Death of a Person, a felony, one (1) count; and Driving Under the Influence of Alcohol (> .15 BAC), a misdemeanor, one (1) count.

Daniel Lee Alderman, 37, French Creek, Driving While License Revoked for DUI, 3rd or Subsequent Offense, a felony, one (1) count; Fleeing in a Vehicle with Reckless Indifference to the Safety of Others, a felony, one (1) count. No Insurance, a misdemeanor, one (1) count; Improper Use of Evidence of Registration, a misdemeanor, one (1) count; and False Motor Vehicle Inspection Sticker, a misdemeanor, one (1) count.

The Upshur County Prosecuting Attorney’s office notes that “an indictment is merely an accusation. All defendants are presumed innocent unless and until proven guilty.”
